SCYON™ TAKEOFF PROGRAM - TERMS AND CONDITIONS1. By registering to join the Scyon™ TakeOff Program ("the Program") and become a Program Member, Program Members are deemed to accept these Terms and Conditions.2. Registration is only open to Australian residents aged 18 years or over who have a current builder's or carpenter's licence. Employees (and their immediate families) of James Hardie, participating retailers and agencies associated with this program are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3. Further, registration is not open to parties already receiving benefits under other James Hardie programs like the Smarter Partner Program or Business Builder. 4. Program Members will be eligible for the benefits offered under the Program and to participate in the competitions and reward schemes run by James Hardie as part of the Program from time to time. 5. In addition to these terms and conditions, any competitions and reward schemes under the Program will be subject to any terms and conditions of entry published specifically for each competition or reward scheme or otherwise referred to on the Program website. Any such specific terms and conditions will take precedence over these terms and conditions to the extent of any conflict between the two. 6. If a Program Member: (i) purchases any relevant products on delayed payment terms and fails to pay for them by the due date; (ii) purchases relevant products and subsequently returns them to the vendor for a refund or credit; (iii) submits an invalid invoice or an invoice previously submitted; or (iv) acts in a way which James Hardie considers contravenes the terms or spirit of the Program this may, in the absolute discretion of James Hardie, result in the invalidation of some or all of a Program Member's claimed purchases and points balances under the Program and forfeiture of some or all rights to a prize, reward or benefit. 7. Receipts will only be accepted that are dated on or after the Member's account activation date into the Program. 8. Any prizes, rewards or benefits offered under the Program or accumulated points balances in respect of any reward scheme are non-transferrable and may not be exchanged or redeemed for cash. If any prize, reward or benefit, or part of any prize, reward or benefit, is unavailable, for whatever reason, James Hardie reserves the right to substitute any prize, reward or benefit (or part of it) for a prize, reward or benefit of equal or greater value and/or specification, subject to state regulation. 9. Calculation methods for Easy Points™ and Tool Tally are as detailed on website and may be changed without prior notice from time to time. Further, James Hardie reserves the right to suspend, cancel or vary the Program or any part of it, including but not limited to these terms and conditions and the terms of any reward schemes, at any time at its sole discretion. James Hardie will have no liability in respect of any accumulated points balances that become unusable from the time of any such suspension, cancellation or variation. 10. James Hardie's decision on all matters relating to the Program, including but not limited to the award of any prize or reward, is final and no correspondence will be entered into. 11. Program Members consent to James Hardie using the Program Member's name, likeness, image and/or voice in the event they are a winner of a competition or qualify for program rewards (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Program (including any outcome), and promoting any products manufactured, distributed and/or supplied by James Hardie. 12. In addition to and without limiting its rights under paragraph 9, if the Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of James Hardie, James Hardie reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Member; and/or (b) to modify, suspend, terminate or cancel the Program, as appropriate, subject to any written directions of a regulatory authority. 13. James Hardie takes no responsibility for and excludes all liability whatsoever and howsoever arising in relation to any technical issues relating to the performance or non-performance of any website relating to the Program. This includes but is not limited to the exclusion of any claims or liability arising from a Member's inability to redeem rewards or enter a competition or promotion within a specified timeframe or by a certain date or time for any reason including but not limited to the inaccessibility of a website or other problems experienced in lodging entries or information online. 14. Except for any liability that cannot be excluded by law, James Hardie (including its officers, employees and agents) excludes all liability (whether arising under contract, in equity, negligence or any other tort, under statute or otherwise at all), for any personal injury or death, or any costs (including legal costs), loss or damage whether direct, indirect, special or consequential, or any loss of profit or opportunity arising in any way out of the Program, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under James Hardie's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize or reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by James Hardie) due to any reason beyond the reasonable control of James Hardie; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a participant, winner or entrant; or (g) participating in or use of a prize or reward. 15. James Hardie collects personal information in order to conduct the Program and may, for this purpose, disclose such information to third parties, including, but not limited to agents, contractors, prize and reward suppliers and, as required, to Australian regulatory authorities. Membership is conditional on providing this information. James Hardie may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity, research and profiling purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct this information to James Hardie. 16. Membership of the Program is conditional upon the Member providing its ongoing consent to receipt of electronic messages from James Hardie. Withdrawal of this consent invalidates the right to continued membership of the Program. 17. All or any competition entries associated with the Program become the property of James Hardie. 18.
